These Terms & Conditions apply to the provision of services by JR Surfacing to residential and commercial customers.

By accepting a quotation, booking our services or instructing us to carry out work, you agree to these Terms & Conditions.

1. Our Services

JR Surfacing provides surfacing, groundwork, paving, landscaping and related outdoor services.

The exact scope of work will be confirmed within your quotation or written agreement.

2. Quotations

Quotations are based on the information available to us at the time of assessment.

Unless otherwise stated:

  • Quotations are valid for the period stated on the quotation.

  • Work not included within the original quotation may incur additional charges.

  • If unforeseen ground conditions, drainage issues, underground services or other circumstances are discovered, we will discuss any necessary additional work and costs with you before proceeding where reasonably possible.

  • Verbal discussions will not override the agreed written quotation unless confirmed in writing.

3. Deposits and Payments

Where a deposit is required, the amount and payment terms will be stated on your quotation or invoice.

Deposits may be used to secure materials, labour, equipment and your scheduled project date.

The remaining balance is payable in accordance with the payment terms stated on your invoice.

JR Surfacing reserves the right to suspend or delay work where agreed payments are not made when due.

4. Changes to the Work

If you request changes or additional work after accepting a quotation, JR Surfacing may provide an updated price before carrying out the additional work.

Changes may affect the project cost and completion timescale.

5. Access to the Property

You are responsible for ensuring reasonable access to the property and working area at the agreed times.

You must inform JR Surfacing of any known restrictions, access problems, underground services, private drainage, cables, pipes or other hazards that may affect the work.

Where access is restricted or unavailable, additional costs or delays may occur.

6. Existing Ground Conditions and Hidden Issues

Groundwork and surfacing projects can involve conditions that cannot reasonably be identified before excavation or removal of existing surfaces.

These may include:

  • Poor or unstable ground

  • Unrecorded drainage

  • Underground pipes or cables

  • Tree roots

  • Unexpected concrete or foundations

  • Contaminated or unsuitable materials

  • Waterlogged ground

  • Previously installed structures

Where such issues require additional work or materials, we will discuss the situation with you and agree any additional costs where reasonably possible before proceeding.

7. Underground Services

JR Surfacing will take reasonable care when carrying out excavation and groundwork.

Customers must provide details of any known private or unrecorded underground services.

JR Surfacing cannot accept responsibility for damage to concealed or incorrectly located services where their position could not reasonably have been identified before work commenced.

8. Materials and Appearance

Natural and manufactured materials can vary in colour, texture, shade, size and appearance.

Samples and photographs are intended as a guide and may not exactly match the finished installation.

Where appropriate, customers should inspect and approve material choices before installation.

9. Weather and Delays

Outdoor work may be affected by adverse weather, ground conditions, material availability, supplier delays, equipment failure or circumstances outside our reasonable control.

Where this occurs, JR Surfacing will make reasonable efforts to minimise delays and keep you informed.

10. Customer Responsibilities

Customers are responsible for:

  • Providing accurate information about the property and proposed work

  • Providing reasonable access

  • Obtaining any permissions that are specifically the customer’s responsibility

  • Removing or securing personal belongings from the working area

  • Informing JR Surfacing of known hazards or restrictions

  • Ensuring pets and children are kept away from active working areas

11. Completion and Snagging

Once work is substantially complete, the customer should inspect the completed work and notify JR Surfacing of any genuine defects or issues as soon as reasonably possible.

JR Surfacing will be given a reasonable opportunity to inspect and rectify any workmanship issue for which we are responsible.

Minor differences in natural materials, settlement or weather-related changes do not necessarily constitute defective workmanship.

12. Workmanship

JR Surfacing will carry out its services with reasonable care and skill.

Where workmanship is found to be defective and JR Surfacing is responsible, we will seek to rectify the issue within a reasonable period.

This does not cover damage, misuse, alterations by third parties, normal wear and tear, movement caused by underlying ground conditions or circumstances outside our reasonable control.

13. Cancellation

If you wish to cancel or postpone work, please contact JR Surfacing as soon as possible.

Cancellation charges may apply where materials have already been ordered, work has commenced, labour or equipment has been specifically booked, or other non-refundable costs have been incurred.

Where you are a consumer and the Consumer Contracts Regulations 2013 apply, your statutory cancellation rights will apply where relevant.

14. Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Subject to this, JR Surfacing will not be responsible for losses caused by circumstances outside our reasonable control or by information, instructions or conditions provided by the customer that were inaccurate, incomplete or concealed.

15. Photography and Completed Work

JR Surfacing may request permission to photograph completed projects for our portfolio, website or marketing.

We will only use identifiable images of a customer’s property for marketing purposes where appropriate permission has been provided.

16. Complaints

If you have a concern regarding our services, please contact JR Surfacing as soon as possible so that we have an opportunity to investigate and resolve the matter.

17. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any applicable consumer rights.

18. Statutory Rights

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

Where applicable, the services provided by JR Surfacing will comply with relevant UK consumer protection legislation.
